The Commission’s statutory powers come under the Local Government Act 1993. Section 195 of the Act provides:

1. The Commission must make recommendations to the Minister about the allocations of the amount of (the “financial assistance amount”) the State is entitled to receive from the Commonwealth under the Local Government (Financial Assistance Act 1995 (C'wlth) for financial assistance for local government purposes.

2. The Commission must also make recommendations to the Minister about a matter referred to it by the Minister about the finances of one or more local governing bodies.

3. In making recommendations under subsection (1), the Commission must comply with the Commonwealth Act.
